En este segundo documento nos ocupamos del aborto realizado por motivos terapéuticos o, dicho más brevemente, del aborto terapéutico. En la Argentina, el aborto plantea serios desafíos para la salud pública, ya que, pese a estar prohibido, se practica de forma clandestina y, muchas veces, insegura, poniendo en riesgo la vida y la salud de las mujeres. Por esta razón, creemos que la sociedad y el Estado deben debatir este problema y encontrar soluciones que resguarden los derechos de las mujeres. (...) El artículo 86, inciso 1, del Código Penal argentino expresamente despenaliza el aborto cuando corre peligro la vida o la salud de la mujer. En estos casos, se habla de aborto terapéutico. Esta disposición legal no suele aplicarse ni por los médicos ni por los profesionales que trabajan en la justicia, ya sea por desconocimiento o por razones ideológicas. Más aún, en muchos casos, las interpretaciones del Código Penal se apartan de su letra y restringen arbitrariamente su aplicación. Por estas razones, nos parece importante analizar este problema y proveer información sobre los aspectos legales y éticos involucrados en el aborto terapéutico en la Argentina. Este documento comienza con el relato de un caso hipotético, elaborado a partir de experiencias reales, con el objetivo de acercar al público a una situación concreta. Intercaladas en el cuerpo del relato, se desarrollan algunas reflexiones acerca de las implicaciones médicas, éticas y legales del caso. A continuación, se presenta un apartado referido al marco legal en el que se deben encuadrar los casos de aborto no punible. El documento sigue con una serie de breves recomendaciones destinadas tanto a los profesionales que trabajan en el sistema judicial como a los profesionales de la salud. Por último, se incluye un apéndice que contiene los principios que rigen la interpretación en materia penal y el glosario médico y legal, donde se pueden buscar las palabras resaltadas a lo largo del documento. Emotional competence has an important influence on development in school. We hypothesized that reading and discussing children’s books with emotional content increases children’s emotional competence. To examine this assumption, we developed a literature-based intervention, named READING and FEELING, and tested it on 104 second and third graders in their after-school care center. Children who attended the same care center but did not participate in the emotion-centered literary program formed the control group ( n = 104). Our goal was to promote (...) emotional competence and to evaluate the effectiveness of the READING and FEELING program. Emotional competence variables were measured prior to the intervention and 9 weeks later, at the end of the program. Results revealed significant improvements in the emotional vocabulary, explicit emotional knowledge, and recognition of masked feelings. Regarding the treatment effect for detecting masked feelings, we found that boys benefited significantly more than girls. These findings underscore the assumption that children’s literature is an appropriate vehicle to support the development of emotional competence in middle childhood. (shrink)

This paper aims to review the empirical and theoretical research on engineering ethics education, by focusing on the challenges reported in the literature. The analysis is conducted at four levels of the engineering education system. First, the individual level is dedicated to findings about teaching practices reported by instructors. Second, the institutional level brings together findings about the implementation and presence of ethics within engineering programmes. Third, the level of policy situates findings about engineering ethics education in the context of (...) accreditation. Finally, there is the level of the culture of engineering education. The multi-level analysis allows us to address some of the limitations of higher education research which tends to focus on individual actors such as instructors or remains focused on the levels of policy and practice without examining the deeper levels of paradigm and purpose guiding them. Our approach links some of the challenges of engineering ethics education with wider debates about its guiding paradigms. The main contribution of the paper is to situate the analysis of the theoretical and empirical findings reported in the literature on engineering ethics education in the context of broader discussions about the purpose of engineering education and the aims of reform programmes. We conclude by putting forward a series of recommendations for a socio-technical oriented reform of engineering education for ethics. (shrink)

This target article considers the ethical implications of providing prenatal diagnosis (PND) and antenatal screening services to detect fetal abnormalities in jurisdictions that prohibit abortion for these conditions. This unusual health policy context is common in the Latin American region. Congenital conditions are often untreated or under-treated in developing countries due to limited health resources, leading many women/couples to prefer termination of affected pregnancies. Three potential harms derive from the provision of PND in the absence of legal and safe abortion (...) for these conditions: psychological distress, unjust distribution of burdens between socio-economic classes, and financial burdens for families and society. We present Iran as a comparative case study where recognition of these ethical issues has led to the liberalization of abortion laws for fetuses with thalassemia. We argue that physicians, geneticists and policymakers have an ethical and professional duty of care to advocate for change in order to ameliorate these harms. (shrink)

Ever since Freud pioneered the “talking cure,” psychologists of various stripes have explored how autobiographical narrative bears on self-understanding and psychic wellbeing. Recently, there has been a wave of philosophical speculation as to whether autobiographical narrative plays an essential or important role in the constitution of agentic selves. However, embodiment has received little attention from philosophers who defend some version of the narrative self. Catriona Mackenzie is an important exception to this pattern of neglect, and this paper explores Mackenzie’s work (...) on embodiment and self-narrative with the aim of better understanding the adequacy of autobiographical narrative as an account of the agentic self. I argue that Mackenzie’s narrative account of embodied subjectivity and agency is incomplete, for it over-estimates the reach of narrative and underestimates the cognitive and agentic powers of the lived body. É amplamente reconhecido que para mitigar a mudança climática antropogênica são necessários urgentes esforços institucionais em várias dimensões: tecnológicos, infraestruturais, mas também socioculturais. Isso significa que, para que haja a transição ecológica para uma sociedade mais verde e sustentável, um conjunto de mudanças estruturais econômicas, políticas e culturais deverão ser rearticuladas nos próximos anos. Por um lado, ao passo que é inegável que, para conter a mudança antropogênica, o uso do poder institucional deve ser usado de modo mais incisivo nas (...) mais diversas esferas que estruturam o social. Por outro lado, não fica evidentemente se as liberdades serão afetadas e, em caso positivo, como elas serão afetadas. Diante da urgência do problema, o artigo propõe normativamente explorar o conflito entre, por um lado, a exigência do uso do poder institucional para conter a mudança climática antropogênica em tempo e, por outro, a garantia pelo mais amplo esquema de liberdades políticas, econômicas e civis nas sociedades democráticas liberais. Em Uma Teoria da Justiça John Rawls ao eleger como bem primário mais importante as bases sociais do autorrespeito (autoestima), aponta que a capacidade do indivíduo de reconhecer seu próprio valor moral e a legitimidade do seu plano de vida também é objeto de justiça social. Martha Nussbaum, Axel Honneth e Avishai Margalit defendem que a humilhação privaria os indivíduos de respeitarem (ou estimarem) a si mesmos. Neste artigo será salientado como cada autor, à sua maneira, salienta pontos sobre a (...) humilhação: a humilhação institucional (Avishai Margalit), a humilhação como a face pública da vergonha social (Martha Nussbaum), e por fim a humilhação como rompimento de expectativas normativas de reconhecimento (Axel Honneth). O debate fomentado nos anos oitenta entre liberais e “comunitaristas” tende a contrastar radicalmente as concepções teóricas de John Rawls e Charles Taylor, sendo o primeiro o representante principal da vertente liberal e o segundo do “comunitarismo”. Ao contrário do que sustenta essa distinção, neste artigo proponho ir para além dela, a fim de defender que há convergências dos autores no que tange à discussão sobre o pluralismo. Em um primeiro momento, apresento os diagnósticos de Rawls e de Taylor quanto (...) ao fato do pluralismo nas sociedades modernas como uma característica contextual irreversível (I). Em um segundo momento, diante da tensão ética insuperável entre divergentes concepções bem, a saída mais viável caminha para a justiça. Para tanto, desenvolvo a concepção de “justiça política” de Rawls em “O Liberalismo Político” e as publicações mais recentes de Charles Taylor como em “Secularism and Freedom of Conscience”, “A Secular Age” e “Why We Need a Radical Redefinition of Secularism?”, que parecem sustentar certa “virada liberal-rawlsiana” no pensamento do autor (II). Em um terceiro momento, efetuo uma distinção entre o fato do pluralismo (razoável) e o valor do pluralismo, para finalmente concluir o artigo argumentando que tanto Rawls como Taylor tendem a defender o pluralismo como um valor político para as instituições e não como um valor moral abrangente para os indivíduos. Background During the first weeks of March 2020 in Spain, the cases of severe respiratory failure progressively increased, generating an imbalance between the clinical needs for advanced life support (ALS) measures and the effective availability of ALS resources. To address this problem, the creation of triage committees (TC) was proposed, whose main function is to select the best candidates to receive ALS. The main objective of our study is to describe the clinical characteristics of the patients evaluated by the TC (...) of the Alcorcón Foundation University Hospital (AFUH) during the first wave of SARS CoV-2. Other objectives are to determine if there are differences between the patients considered candidates / not candidates for ALS and to analyze the functioning of the TC. Methods Retrospective observational study of all patients assessed by the AFUH TC. Results There were 19 meetings, in which 181 patients were evaluated, 65.4% male and with a mean age of 70.1 years. 31% had some degree of functional dependence, the Barthel median was 100 and Charlson 4. 58.5% were not considered a candidate for ALS at that time. The patients considered candidates to receive ALS were younger (72 vs 66; _p_ Conclusions The patients evaluated by the TC had a mean age of 70 years, high comorbidity and almost a third had some degree of functional dependence. More than half were not considered candidates for ALS at that time, these patients being older, with more comorbidity and a worse previous functional situation. TC decisions, based on objective clinical criteria, were almost always respected. Public institutions must get involved in triage procedures, which should and in our opinion must include the creation of TC in health centers. The implementation of Anticipated Decision programs (ADP) would help enable patients affected by triage decisions to participate in them. (shrink)

Of the many translators who carried the Buddhist doctrine to China, Paramartha, a missionary-monk who arrived in China in AD 546, ranks as the translator par excellence of the sixth century. Introducing philosophical ideas that would subsequently excite the Chinese imagination to develop the great schools of Sui and T'ang Buddhism, Paramartha's translations are almost exclusively of Yogacara Buddhist texts on the nature of the mind and consciousness. This first study of Paramartha in a Western language focuses on the Chuan (...) shih lun (Evolution of Consciousness), a text that reveals the outline of Paramartha's Yogacara thought. The study begins with a discussion of Paramartha's life, the historical and political context of the time in India and south China, and the roles of his main disciples in disseminating his work. It then describes Paramartha's treatment of Yogacarin views on language and the process of cognition, both central to this system of thought. The final chapter analyzes the history and content of the Chuan shih lun, and the book concludes with a new translation of the text, with extensive annotations. (shrink)

En el año 2006 se reconoció constitucionalmente la etnia diaguita como parte de los pueblos originarios de Chile. En paralelo, se generó un amplio debate que transitó desde lo político hasta lo académico, éste último haciendo referencia a los enfoques interpretativos de este fenómeno. De esta discusión surgieron diferentes terminologías para retratar este proceso, tales como la emergencia indígena y reetnificación. Sin embargo, a mi juicio, hubo un concepto que fue quedando atrás, al menos en el debate formal; el de (...) etnogénesis. El caso diaguita, entre varios, permite, entre otras muchas posibilidades de reflexión, abrir la discusión teórica para la comprensión de los resurgimientos y reivindicaciones identitarias contemporáneas. El presente artículo se propone reflexionar en torno a la pertinencia del uso del concepto de etnogénesis en la actualidad, para la comprensión de los fenómenos recientes de emergencias de nuevas identidades indígenas, similares al proceso diaguita, a través de una trayectoria crítica del término. This compact and innovative book tackles one of the central issues in drug policy: the lack of a coherent conceptual structure for thinking about drugs. Drugs generally fall into one of seven categories: prescription, over the counter, alternative medicine, common-use drugs like alcohol, tobacco and caffeine; religious-use, sports enhancement; and of course illegal street drugs like cocaine and marijuana. Our thinking and policies varies wildly from one to the other, with inconsistencies that derive more from cultural and social values than (...) from medical or scientific facts. Penalties exist for steroid use, while herbal remedies or cold medication are legal. Native Americans may legally use peyote, but others may not. Penalties may vary for using different forms of the same drug, such as crack vs. powder cocaine. Herbal remedies are unregulated by the FDA; but medical marijuana is illegal in most states. Battin and her contributors lay a foundation for a wiser drug policy by promoting consistency and coherency in the discussion of drug issues and by encouraging a unique dialogue across disciplines. The contributors are an interdisciplinary group of scholars mostly based at the University of Utah, and include a pharmacologist, a psychiatrist, a toxicologist, a trial court judge, a law professor, an attorney, a diatary specialist, a physician, a health expert on substance abuse, and Battin herself who is a philosopher. They consider questions like the historical development of current policy and the rationales for it; scientific views on how drugs actually cause harm; how to define the key notions of harm and addiction; and ways in which drug policy can be made more consistent. They conclude with an examination of the implications of a consistent policy for various disciplines and society generally. The book is written accessibly with little need for expert knowledge, and will appeal to a diverse audience of philosophers, bioethicists, clinicians, policy makers, law enforcement, legal scholars and practitioners, social workers, and general readers, as well as to students in areas like pharmacy, medicine, law, nursing, sociology, social work, psychology, and bioethics. Personalist thought offers fundamental perspectives which are able to shape the broader fields of philosophy, theology, and related areas of study. Familiarity with the scope of its recent developments is valuable not only for personalist scholars but also for those interested in non-materialist thought and especially the problems and questions of the person in various aspects. This work, bringing together papers from a 2019 conference, aims to serve these readerships. It will also provide an archival record of the state of (...) the field at this point in Western intellectual history. In terms of content, the work addresses four general themes: personalist thought as it is encountered in the writings of particular scholars; the place of personalism within broader philosophical thought; personalist engagement with major religious traditions; and the application of personalist modes of thinking to a range of real-world questions. El presente trabajo analiza la construcción del espacio caribeño en la novela Rastro de sal de la escritora costarricense Arabella Salaverry. Este espacio se aborda desde dos perspectivas específicas: una, vinculada con la representación general del espacio caribeño. Este análisis se centra en tres relaciones concretas: conectividad/aislamiento, naturaleza/cultura, centro/periferia. La segunda perspectiva se interesa más bien en los espacios domésticos y su interacción con los personajes femeninos, a partir de las relaciones libertad/prisión e interior/exterior. Se concluye que, en Rastro de (...) sal, el Caribe se presenta como un espacio contradictorio, dinámico y desigual. (shrink)

The necessity of consideration of the phenomenon as an interdisciplinary synthesis of work on religion, philosophy, theology, mythology, culture, history and ethnic psychology. Consider the views of Western experts and the state of the problem in Ukraine. Analytical review of the literature on the problems investigated allowed to select the structural elements of demonology. La experiencia del juego no es extraña para ninguno de nosotros. Todos en algún momento de nuestra infancia nos hemos sumergido en el mundo que nos abre la fantasía y los juguetes. El presente texto se propone explicitar desde una perspectiva fenomenológica cómo tiene lugar esta particular mezcla de percepción y fantasía. Para que esta experiencia no se confunda con una alucinación o simple simulación, se plantea como hipótesis que el juego se puede analizar como una modalidad particular de la (...) fantasía perceptiva en el modo del «como si», en la que, sobre la base de una aprehensión perceptiva, que se presenta neutralizada, se abre el mundo de fantasía que se despliega en el juego. Bajo este hilo conductor el texto se organiza en tres momentos: primero, descripción general de la conciencia de fantasía; segundo, análisis de la fantasía perceptiva en la experiencia del teatro; y finalmente, descripción de la especificidad de esta modalidad de la conciencia de fantasía, denominada fantasía perceptiva, en la estructura intencional propia del juego en los niños. The policies that the authors put forward to advance this vision include flexibility in the rules related to employment protection to avoid deeper segmentation of the labour market; the creation of social protection systems to cover all workers; the provision of broad access to education and skill formation at different stages of life; the guarantee of equal opportunities and non-discrimination; and respect for collective bargaining. This essay explores four aspects of Gruen's theory. The first section considers her analysis of the concepts of sympathy, pity, and emotional contagion. The second section outlines the main features of her conception of empathy and highlights some worries about empathy that her theory addresses. The third section examines empathy's contributions to moral epistemology. The fourth section queries Gruen's contention that empathy is morally motivating.

It is with deep sadness that I report the death of Joel Kupperman, University of Connecticut Board of Trustees Distinguished Professor Emeritus. He died in Brooklyn, New York on April 8, 2020.Joel received both his B.A. and M.A. from the University of Chicago and his PhD from Cambridge University. He joined the Philosophy Department at the University of Connecticut in 1960. Except for visiting Trinity College, Oxford as a lecturer in 1970, two years supported by NEH fellowships, and fellowships at (...) Clare Hall, Cambridge and Corpus Christi College, Oxford, he remained at UConn until his retirement from teaching in 2013. This paper will examine the experience of and drive for bodily invisibility in women through the theoretical approaches of phenomenology and social constructionism. An examination of the social disruptions of bodily invisibility and the compulsive avoidance of such instances, particularly with respect to the fastidious maintenance of body comportment and appearance within the narrow parameters afforded by social norms, will lead to an exploration of the conflation of biomedicine with the beauty industry.

In this article I examine some proposals for modification of ethical documents regulating research, particularly, the problems that introducing certain economic clauses may pose. I evaluate suggestions that reject the notion of providing the ‘best proven diagnostic and therapeutic method’ in favor of ‘the highest attainable therapeutic method’ or ‘the proven effective prophylactic, diagnostic and therapeutic methods’. I analyze the plausibility and problems of introducing a double standard and the consequences it may have in developing countries.
